Grand Terrace recall effort begins anew

Stephen Wall, Staff Writer
San Bernardino County Sun

GRAND TERRACE - For the third time in three weeks, a group of residents has started the process to remove two City Council members from office.

Bill Hays last week presented notices of intent to circulate recall petitions to Mayor Maryetta Ferre and Councilwoman Lee Ann Garcia.

"If at first you don't succeed, try, try again," said Hays, a 59-year-old De Berry Street resident who is leading the recall effort.

Recall proponents accuse Ferre and Garcia of being fiscally irresponsible and using redevelopment funds to benefit private interests.

They also say the council members violated state law by holding secret meetings and making illegal decisions.

Ferre and Garcia said the accusations have no merit.

"All the allegations are false," said Garcia, who has served on the council since 1996. "I will continue to work for the good of the citizens of Grand Terrace. I would ask all the residents to please review the facts before signing anything."

Recall proponents twice failed to meet the requirements of the state Election Code to get their movement off the ground.

In mid-May, they submitted notices to City Clerk Brenda Mesa that lacked signatures, addresses and other information required to start the process.

On May 25, they handed Ferre and Garcia notices of intent to recall petitions, but the documents did not have the printed names next to the signatures of 20 Grand Terrace residents.

On Monday, Mesa said, she plans to review the notices filed Thursday to determine if they are sufficient.

If the forms are approved, proponents would have 90 days to collect about 1,500 signatures, which equates to 25 percent of the city's roughly 6,000 registered voters.

If enough valid signatures are turned in and other requirements are met, a recall election would be held in November.

Hays said Councilwoman Bea Cortes also would have been targeted in the recall attempt, but she is up for re-election in November and is likely to face opposition from other candidates.

"I think it's ridiculous," Cortes said of the recall effort. "It's a certain group that opposes every item that comes before us."

Hays said recall supporters would gather signatures at the Stater Bros. Shopping center and on busy street corners in the city.

"It's not going to be that difficult," Hays said. "We're optimistic we will have the signatures rather quickly."

Recall proponents criticize Ferre and Garcia for supporting projects they say harm residents, such as a proposed shopping center on Barton Road, an outdoor-themed retail center, a senior-housing complex and other developments.

"The biggest thing is they don't listen to the community," Hays said. "There's a handful of people that are in a special clique that they listen to, and that's it."

Ferre, who has been on the council six years, said she would not respond to the specific accusations until the recall qualifies for the ballot.

"I think it's important that Grand Terrace residents consider putting their passions toward the solving of problems, making suggestions and supporting decisions that will make this city prosper - not toward distractions that can destroy a community such as recall petitions," Ferre said.

Gramps Must Comment:

Were the Recall Petitions Served 2 times or 3? Not that it matters much but, the writers of the Recall are not professional Recall Writers or folk with a bunch of lawyers or practiced politicians with staffs educated on the Election Laws of the State of California.

It is one of the Tasks descriptions of the City Clerk to function as the "Election Official" for Local Recall elections. The City Clerk is to review and advise citizens through the process, of submitting the required papers for their desired action be it recall, inactive (Measures on Specific Ordinances), running for office, and even after running for office filling out the required disclosure forms. What is being counted as the First Service or Attempt at a recall was not a Service of Notice, it was an attempt to check the paper works acceptability.

The Clerk did not specificity advice the petitioners they needed to have a Print Your Name, and a Sign Your name and Print your Address for each signature. Not to imply that she error as the form looked as if this was understood as there were plenty of lines and spaces for doing so.

The City Clerk has been helpful in guiding the citizens through the steps of who does what when, as the documents go from Intent to Recall, to Publication of Intent, to The Response to Intent To Recall, to the Recall Petition, to the Submission of the Recall Petitions, and finally the Documents for the Recall to be on the Ballot. The paper trail has many paths.

The second attempt to serve the first actually signed and served to the Council Members being recalled lacked the Printed Information of Name, and Complete Address for each of the Signers. This was the extent of the problems. Nothing major, easy to correct. The most difficult part was limiting the number of people wanting to sign the document. The text of the document did not change.

The third attempt to serve by Mayor Ferre's count was the one where she made her most recent comment which is telling of her attitude toward citizens in general.

Mayor Ferre doesn't respond to citizens asking for full campaign contribution disclosures. Mayor Ferre doesn't allow the council members to discuss general questions raised by citizens at council meetings. Mayor Ferre's characterization of the citizens use of a recall to "destroy a community is the ultimate pretentiousness. Recall is a legitimate Political Option to correct a situation of bad governance in order to PROTECT and PROMOTE a good community.

Mayor Ferre, has perpetuated a climate and even rules that eliminate or frustrate citizens from being able to solve problems, and make suggestions. When and IF the council does something that will make this city prosper those actions will be supported. However, this council perpetuates improper procedural practices from the City Manager, Planning Department, Planning Commission, Finance, and throughout the entire City. These are the cause of law suits.

The use of the Redevelopment Agency Funds and the Debt of the Redevelopment agency and how that Debt effects the City is of Great concern and the cause of the Recall the lack of competitive bids on City and RDA contracts and opportunities is a Great Concern.

It is time to clean house. Two to be recalled, Two to be up for election. Not to destroy a community but to SAVE IT, to Let is Prosper with Pride and dignity.

Now for the other Council Member Comments

"All the allegations are false," said Garcia, who has served on the council since 1996. "I will continue to work for the good of the citizens of Grand Terrace. I would ask all the residents to please review the facts before signing anything."

Yes.. Council Member Garcia has it half right again. The allocations are not false, and the Citizens should review all the facts before signing anything. Fact: When you sign a recall petition it puts the recall on the ballot, it does not say who you vote for or what your opinion is. It is saying You Think the Citizens should Vote and Decide the ISSUE.

Council Member Cortes Statement:

"I think it's ridiculous," Cortes said of the recall effort. "It's a certain group that opposes every item that comes before us."

Recall is a constitution right in California, is it this recall or any recall she opposes? When she follows that statement with an all inclusive absolute statement that "it's a certain group that opposes every item that comes before us” she exposes a flaw in her characterization and understanding of the situation. No group has in fact been against every item.

It appears Council Member Cortes is of the opinion there are two kinds of citizens, or two groups. Any one who opposes an item is against "US" and those who agree with "US" or let "US" do anything "WE" want. Everyone else is a "THEM", or a "THEY". This over classification of individuals expressing concerns and opinions and reviling facts and yes flaws in the procedures of the governance of this community are all THEM. Perhaps the THEMS... Should figure out how to make THEMS into an official group name. This would be impossible as there is not a group with a single mind which brings forth objection to the actions of the city council and its manager. Yes, the THEMS have rights and THEY are using those rights, not for self protection or self promotion, but to HELP the City.

Does the City Really Support Youth Sports?

Have you stopped to think if our city leaders really support the youth sports groups in town? If you are like me, this thought crosses your mind every now and then and this past weekend at Grand Terrace Days got me thinking again. There are three youth sports organizations in Grand Terace that provide services that the city does not provide, and that is a safe and supervised environment for the youth of Grand Terrace to learn valuable life lessons.

But this past weekend you saw the city forget to reserve a space at Rollins Park for Little League until Friday night and then they also allowed another youth soccer group that has no ties to the community have a boo;th that served as a fund raiser for them. This soccer group's only tie to the community is that some of the players reside in Grand Terrace.

The city has a history of showing support for the kids when it makes them look the best in the community's eyes. Take for example a few years back when the remodel of Rollins Park was taking place. The city refused to sign a grant paper work that soccer had presented that wouldl have given the project another $50,000 to $75,000 to help fund the additional game lights. This was not signed because the city did not like the fact that it had to grant soccer rights to use for a specific amount of time. This grant money in turn went to Colton Soccer for their projects. You can also look at the lack of proper lighting at Pico Park for the youth basketball to practice under, or the same of the restrooms at Pico Park. These youth sports groups provide a tremendous service to the community and give bacxk to it as well through time and money spent supporting them. The city needs to take a hard look at this and realize that between the 3 organizations there are a large number of voters, who if joined together, could make some serious noise in the city,.

The city needs to take a long hard look at the effort and time that all the members of Soccer, Little League and Basketball put into the youth of this community and start showing a bit more support and work closer with the groups and not against them. The city needs these groups more every year since it does not have a budget to provide an outlet like this to the children of this community.

Chris Evans, Grand Terrace

I would like to add, and why does the City Mayor, Maryetta Ferre, Councilwoman, Bea Cortez, and Assistant City Manager,Steve Berry, take every chance they can to grandstand their success of these programs. These people do not have a successful program history of anything. It is the hardworking mothers and fathers of children who care.

Review of the City Council Meeting June 8, 2006

Added by Email

Council Member Jim Miller question the $5800 voucher to the company Koontz now works for. He worked two days a week for the City and three days for Nolte Engineering. He no longer works for Nolte and is employed by this new co. Perhaps all the lawsuits he has brought down on the City scared Nolte. Ralph Megna's company is called Empire Development Solutions.

The Claim against the City listed on the Agenda turns out to be alleged damage to Chuck Hornsby’s house/slab caused by the city’s demolition of the Webber House, (House formerly located between the Senior Center and Terrace View Elementary School). Mr. Hornsby was delayed in getting to the meeting and was not allowed to speak as the Council Addressed that Agenda Item Prior to his arrival. They concluded they needed more information prior to accepting the Claims Adjusters Recommendation to Reject the Claim. Mr. Hornsby did not include in his paper work an estimate for repair, nor was there an engineering report showing damage came from what he said it did, and when... This was continued till next meeting, with a request for more information from the Claims Adjuster and Hornsby

Mr. Hilkey suggested it has been like they are the black birds on the wire waiting to get shot at. They have been set up in the past to be the fall guys for the actions of the staff, and he is tired of the process of just accepting the recommendation. He made the motion to continue the issue, Council Member Miller seconded it.

Council Member Lee Ann Garcia interrupted the vote on the motion to continue this item by asking if this was a new policy to not accept the Claims Adjuster’s recommendation, and Staff’s Suggestion on Claims issues. Council Member Hilkey repeated that it was his opinion that this is not like other claims in the past, where the city had not made prior statements to take corrective actions, and the cost of litigation out weighs the cost of repair. To request more information is not unreasonable in this situation and a delay is not going to be a burden on any of the individuals at this point.

Mayor Ferre asked is a continuance where the public can comment again at the next meeting. The City Attorney said yes, and advised the council not to speak to or about the matter until they meet in public forum again. This is why he suggest not allowing continuations as it is difficult to not speak on a subject outside of the council meeting.

. The council did not hear from Mr. Hornsby when he arrived as he was told they had already gone past that agenda item. He will be able to speak and make a presentation of fact.

Crime Prevention Report:
Council Member Miller asked about the lack of names in the Crime Prevention Meeting Minutes, and the Sheriff and Legal Council said inclusion of names of perpetrators alleged or arrested can be released and made public. However, it has not been the practice of the city in the past.

Council Member Miller asked how old is the information contained in the minutes and the response was about six weeks old. Not current, an arrest or apprehension had been made in the case of an old man asking for money.

Mayor Pro Tem Bea Cortes asked about the Event on Barton Road, where a homeowner and son had an encounter with people saying they were going to measure for a fence, and one went into the house and began to steal things, The son came in and found the thief in the house, and chased him out, and was nearly ran over as they perpetrators were trying to flee.

The Sheriff's characterization of the Grafter/Gipsy Home Invasion of Marylou is an insult.

The Sheriff provided no tick tock or time line report or detail of the suspect. Just because there have not been other "Similar" reports... he concluded it is a one time thing. How convenient... No one can check "reports".

The Sheriff failed to report:
When the call came in?
Where the deputy was responding from?
How long it took the deputy to arrive? Reports are that it was 30 minutes or more until the Deputy Arrived. The possibility of an apprehension diminishes as time laps.
What were the Actions of the Responding Deputy?

Reports are the Deputy suggested the Protective Son may have a complaint against him for breaking a mirror on the perpetrators Truck. Did the Deputy call in the truck and identifying information so that immediate information was out so the perpetrators could be apprehended? What was the level of concern, and action taken, to apprehend the suspects?
Did the Deputy tell the victim to preserve the evidence of finger prints, and broken glass?
Did the Deputy tell the victim a Detective would arrive the Next Day?

Development:

The City Council delayed making a decision on the Karger/Pico Development with a direction to the Developer/Engineer to meet with the concerned neighbors adjacent to the property being proposed for development. Each of the issues raised by the neighbors of the project were discussed and deliberated upon. No decision was made and the issue was continued to the July 13th meeting.

Continuance allows for more public comment at the meeting it is on the agenda. Council Members must not speak of the topic with anyone till then...

However, there seems to be a procedural problem related to the Planning Commissions Actions. When the Karger/Pico proposal was in front of the Planning Commission it was continued at the Planning Commission as the meeting went long. At the second meeting the right to public comment was not allowed, and the citizens were barred from a fair hearing, and none of their issues were mitigated or resolved. It needs to be determined if the Planning Commission meeting was not concluded and closed, it was continued and closed? The Planning Commission needs to review its minutes, and practices to make sure that the difference between a continued meeting and a concluded meeting is understood, and recorded properly.

Nice how all the Homeowners were praised for their professional presentations, and attitude as they brought their issues forward to the council. The council made particular effort to have each issue discussed. IF the council conducted itself as prudently in the past there may not be law suits on other developments now pending.

Law suits result from the combined problems or compounded problems which begin at the Planning Department, Planning Commission, and finally the City Council. The procedural problems are at the base of the problems in city management of the development in Grand Terrace.

What we have learned. The Highland Riverside Water Company paid for a great wall which makes the treat of rocks and mud slides and flood insignificant to the development being proposed. Mud and boulders assailing an Orange Grove is different than the same event running through a housing tract. Boulders bounce over walls. Hill side development is always a risk. It is a mater of fact Hills want to be flat.

We have learned the road to the houses will be on top of the aqueduct. How would the homeowners access their homes if this had to be repaired?

We have learned the same problems or issues exist for building as currently zones 15 houses vs the 20 desired by the developer. Twenty Homes being the desired build is for financial reasons only. What is the Financial Impact on the homes adjacent to the development if there is a higher density build out? For the city, more houses, sold at higher values, more property tax.

Perhaps the Existing Ditch Maintained should become the requirement of the new homeowners as they will have the access.

Perhaps the city can be indemnified from action when boulders come bouncing down the hill and mud flows up and over the water company block wall.

Perhaps the Water Company can be indemnified for flooding should the tank break.

Perhaps, Karger/Development can make nice with the neighbors, in such a way that the apparent procedural flaws at the Planning Commission do not result in yet another suit against the city, and city management of development procedures.

We have also learned that WE have Avocado Trees around the water tank. Who gets to harvest the avocados? Perhaps we could have a Guawk GT… where Chips and Dip is served up by sports teams and a concert by all our students in band,… Woops what is that a suggestion?

Closed Meeting: Labor Negotiation

The public portion closed at a closed meeting for labor negotiations. (This is allowed by the Brown Act.)

HOWEVER, locking the doors so that the public can’t re enter the City Council Chambers to hear the announcement of the Results of the Closed meeting is not Legal. It constitutes a violation of the Brown Act. This is a procedural error typical of the type the Council makes at times with intention, and other times with out intention.

What have we learned Throw a good party, and then negotiate. hmm, must remember that tactic.

Did the Planning Committee get as much praise as the Paid City Manager Assistant and his staff for the success of the GT DAYS?

How much time of the City Staff, was used for a one day party? Again is this how we should be spending our funds for police and city staff?

We know that Steve Berry and Staff worked at the GT Days.. Who else has hours spent on the party? We saw Sheriffs, and Firemen. How much did that cost?

Is this really what we want to be known for ....? To be honest, I don't get it... Paying for entertainment for one day... when the community has no Youth Program those same donations could be solicited for. I truly don't get it. Perhaps with the Heehaw.. The Planning committee could involve the community a bit more...Perhaps the 4H sheep and goats, chickens, and a community year of farming could be promoted... Each of the NPO’s in GT should have a booth reserved in the FRONT of the Park, not way back in the back. Guest Vendors and Organizations should be deeper into the “show grounds”.

What happened to the revised policy of the council and mayor document??? did the Adjustments get made... if so the 3 minute rule, and no discussion blurb were still practiced.

OTHER ITEMS BROUGHT BY COUNCIL MEMBERS

Pancake Breakfast Sat June 10… Fire HOUSE… UMMM

The next Chamber Meeting to be the place of ” Aggressive Fire Works Education” . Is this appropriate education forum, a lunch attended by Chamber Members of course the public is invited, but at that hour most citizens are not in town, nor do they feel welcome to pay 8.00 to eat a lunch in a room with a capacity of perhaps 100 lunchers? Is that Education at the Aggressive level?.. Interesting interpretation of the desires of the Fireworks Committee. Interesting. How much will it cost the city for this “Education of the Chamber Members”? Remember to bring cash for the No Host Bar at City Hall during these meetings.

Remember: Age is 55-56 not 65 that is the point needing to be corrected about the statements made about Bea Cortes. That is a fact... hmm one would think there were more interesting things to correct.

It is Cortes not Garcia who is 55 not 65... Correction Made...

Recall in the Press and comment by Gramps

Mayor, council member get petitions
GRAND TERRACE: A group makes its second effort to launch a recall of the two officials.

10:00 PM PDT on Thursday, June 8, 2006
By JULIE FARREN
The Press-Enterprise

GRAND TERRACE - The mayor and a council member silently accepted petitions Thursday in a second attempt by citizens to start what could be the city's first recall drive.

"If at first you don't succeed," resident Bill Hays said as he approached the podium for the second time in two weeks to kick off a recall.

The petitions of intent served by Hays at the council's May 25 meeting were ruled invalid by City Clerk Brenda Mesa because signatures were not also printed, city officials said at the time.

On Thursday, Hays told council the new petition contains 20 new names and three from the first petition.

The petition targets Mayor Maryetta Ferre and Councilwoman Lee Ann Garcia for reasons including using redevelopment money for private interests and holding secret meetings. Ferre has denied all claims listed by the citizens. She and Garcia did not comment after they were served with the petitions Thursday.

Hays said he and other citizens would speak specifically about their concerns during the two to three meetings before the City Council election in November.

"We will come into the podium and give reasons at each meeting why you and Councilwoman Garcia should be recalled," he said.

What's next

Under California election laws, the petitions of intent to recall Grand Terrace Mayor Maryetta Ferre and Councilwoman Lee Ann Garcia are the first step in the process

Signatures on the petitions must now be validated by the city clerk.

If that happens, Ferre and Garcia would have seven days to respond.

After that, the citizens seeking the recall would have to submit another petition with 1,500 signatures and the responses.

If the 1,500 signatures are validated, a recall election could be held.

Reach Julie Farren at 909-806-3066 or jfarren@PE.com

Grandpa has to add:

There was a response to the Second Serving of the Notice of Intent to Recall:

Mayor Ferre's response was: "This is the third service of Notice which each prior time has been deemed "insufficient". She admonished the citizens of Grand Terrace to try to be supportive of the City Council, by providing solutions, and suggestions, not such activities which are distractions such as the recall.

Lee Ann Garcia's response was she had three things to say: First: All the allegations are False. Second: She will continue to serve the City of Grand Terrace. Third: She issued a direction to the citizens before they sign a petition to look into the facts.

Well, Mayor Ferre, a recall is in fact a potential solution to the city's current management problems. The "Insufficiency" was not related to the reason for the recall rather it was a secretarial flaw, the signators did not also print their names as required. This was a minor format error which the Mayor desires to portray as an "Insufficiency" in order to diminish the efforts validity in the eyes of the public. This is the second not third time this particular intent to recall has been served.

Well, Council Member Garcia, the facts are, even at the June 8th Meeting, the Doors to City Hall were locked so that people wishing to hear the results of the Closed Meeting, which are required to be announced after such meetings, were locked out. The facts are that the city is currently in court as a result of the actions of the City Council, including Mayor Ferre, and Council Member Garcia. The fact is that the rules quote each meeting regarding the Brown Act, and the Council's inability to comment or discuss things brought up by the citizens during the Public Comment Portion of the agenda, is not what the Brown Act, states. The fact is that the Recalled Council Members approved Redevelopment Plans and Actions which have put the city into debt, and used funds for the purpose of providing funds or economic advantage to city employees. Those are just some of the facts the Citizens should consider when they sign the Recall Petition soon to be circulating around town.

Just the facts.

WHEREAS, the boundaries of the 20,000 square foot lot zoning in this portion of Grand Terrace appear logical and cohesive and would diminished by the proposed subdivision.

WHEREAS, building pads are proposed to be built up on several lots which will tower over existing residences on Kingfisher and block views and sunlight.

WHEREAS, walls likely in excess of 9 to15 feet in height or more would be developed that will block views and sunlight and create a visual blight and be a graffiti magnet that current and future property owners will have to maintain.

WHEREAS, an alley/sewer/stormwater treatment facility is proposed which would likely create hazards for adjoining residents which are not being addressed by this development application.

WHEREAS, no specifics on the design of the home were provided and the developer never worked directly with neighboring property owners to resolve any of the aforementioned issues.

New Development Concerns: From NEW People

June 8th City Council
This Will Be Read into the PUBLIC Record of the Meeting:
Development Proposed Hillside/Pico Street

April 20th the Planning Commission conducted a Public Hearing regarding this application. At that time residents of Kingfisher Road, Blue Mountain Court and Pico Street all raised objections to this subdivision as designed.

We raised many concerns related to drainage impacts, building a proposed alley right up to our property line, building sewer and a toxic storm water treatment facility in this alley.

The height of a series of walls that are proposed, the need to build up pads above us, potential two story homes looming even higher over us. We also felt that the proposed zone change isn't necessary. The current zoning allows up to 15 homes to be developed, which is more similar to and a reasonable transition to the existing larger estate homes on Blue Mountain Court.

We also felt that our flimsy wood fence was an inadequate buffer from whatis proposed to be built next to us. Several of us requested a block wall be built along the shared property line to buffer us from vandalism from this new alley, potential accidents with cars rolling down hill into us etc.

The Planning Commission seemed to dismiss this as too expensive. If $60 a lineal feet is assumed the cost for this wall comes out to about $37,500. If this cost is split among 20 homes this equals $1,875 per house, or$2,500 a house for a 15 lot subdivision. If you think of this as adevelopment impact fee and add it to the other fees GT charges the total would still be thousands less than what adjoining cities charge.

We also raised concerns that the zone change will increase traffic on Pico more than the current property zoning would. Pico Street east of Van Buren is really not any kind of an Arterial Street, its double loaded with driveways and kids on both sides of the street to the west of this project. School bus stops exist on or near Pico, kids walk and bike this street as well as Oriole.

In response to our concerns the Planning Commission continued the Public Hearing to May 18th and requested alternative subdivision plans that would implement the current zoning. The properties current zoning allows up to 15 homes on this property.

At the May 18th hearing 3 of the 6 Commissioners that were present for the first hearing didn't show. Two different 15 lot subdivision plans were reviewed but the Public Hearing was not reopened, even though several neighboring property owners requested to speak.

To the neighbors, the follow up Public Hearing was a farce. The Planning Commission really didn't address most of the issues we raised. Residents of Kingfisher have much more invested in getting this design right than the developer does. Our mortgages are much more than what this design cost and we live here. How would you like an alley built up to your property line?

I recommend denial of these applications based on the resolution I handed out with my request to speak. The thing I'd like you to keep in mind is that in terms of tax receipts versus cost of providing services new residential development is pretty much a break even proposition. There is no windfall to the City if you approve this project.

Clearly the folks at the American Planning Association and Urban LandInstitute would also agree with this statement, in a hundred years Lowe's and Savon will likely be long gone but the lots you are considering and future homes to be built on them will still be here.

Recall proponents launch new petition
GRAND TERRACE: The initial effort to remove two from the City Council was invalidated.
10:00 PM PDT on Tuesday, June 6, 2006
By JULIE FARRENThe Press-Enterprise

A group of citizens seeking to recall the Grand Terrace mayor and a council member has gathered 20 more signatures since the city clerk determined last week that the first petition was invalid.

City Clerk Brenda Mesa sent the recall proponents a certified letter Thursday, saying that the petition needed to include printed names, signatures and residential addresses to comply with the state Election Code.

Resident Bill Hays, who served Mayor Maryetta Ferre and Councilwoman Lee Ann Garcia with the recall notices at the May 25 council meeting, agreed with Mesa.

"We didn't have the area (on the petition) for the printed name," Hays said.

The new petition will not be considered valid until the elected officials have been served again, said Tracey Martinez, deputy city clerk.

Hays said that he has been besieged with phone calls from residents who want to sign the petition.

The petitions accuse Ferre and Garcia of various actions ranging from holding secret meetings to exposing the city to litigation by approving unnecessary developments. (This is not quite a fair representation of the Wording)

(Actual Wording Is ............................
The grounds for the recall are as follows: It is our belief that you have failed to fulfill the responsibilities of your office by being fiscally irresponsible and disregarding the lives and safety of our citizens. It is our perception that you have conspired to allocate redevelopment monies to benefit private interests. You have, we believe, violated California law by holding secret meetings and making illegal decisions. It is our belief that you made decisions and conspired in matters affecting public finance, public health and safety, in private, in secret communications, and through third party contacts. We believe that your conduct exposes the City to litigation, including the Brown Act, and liability, the public to harm, and compromises City finances. )

Mesa will review the signatures, and if the petition is declared valid, Ferre and Garcia would have 30 days to respond. The citizens would then be required to gather 1,500 more signatures to move ahead with the recall.

The two council members' current terms expire in November 2008.

Where's the $$ not Who's the Gramps

Who's the Gramps, or Grampa, or GrandpaTerrace continues to be of interest to some folk at the City Hall, Chamber of Commerce, and Blue Mountain Outlook, and their relations.

I have been informed of the latest rounds of speculations. It is Odd the time spent on this question. Why not figure out why the city has a 15 million Debt, which will cost 70 million to pay off. Where is that money being spent, and why?

I have heard Steve Berry is Gramps or even Tom Schwab, all sorts of email has tried to narrow down the likely suspects... If you are asked, are you Gramps, just say back I thought it was YOU. That is perhaps the closest anyone gets to who Gramps is. However, any attempt to get the Blog to narrow down the search for Gramps is not going to work. For those who have been accused of being Gramps, I hope you learn to respect the complement in the future. For those who post or provide information all you little gramps out there... Thanks. Nearly 8000 visits to the Blog this year... IT IS impressive work.

It has been suggested that Gramps is "Employed" to write the blog. What a joke.... IF it were about the money, there would be adds on the blog. The adds would generate income on their own. Because Gramps is faceless, Gramps is also Bankless. Go figure why or what motivates the effort... ISSUES,,, ISSUES.... ISSUES not ego, or payment.

How about finding out why there is not a General Plan, or a Specific Plan which is written in such a way that every Development needs a Special Ordinance, or Zone Change, or waiver... In order to get through the approval process.

How about finding out how to do a Real Environmental Mitigation Report.

How about reporting the results of Closed Meetings, and the Real Compensation Costs to all City Employees, elected, non elected, and contracted.

How about that?

Although this started as a singular effort of one individual, it is not so today. Contributions to the blog are made by many individuals. Most Posts are done administratively by Gramps, Email is answered by Gramps. But, What has that got to do with anything. No one gets paid for this effort.

I find it odd that the Law Firm which Employees the Mayor's Son is a Frequent reader, as are People or Persons employed by the city. WHO IS PAYING YOU TO LOOK FOR GRAMPS, OR TO READ THE BLOG ON THE CLOCK?

Who am I? Are you still asking? What is your point in knowing, or accusing someone of being Gramps, or even IF you Found Gramps, BIG DEAL what has that proven... Nothing. Nothing more than you have wasted time solving a mystery of no concern, when you should be doing things like balancing the budget, running an honorable city management, and so forth.

Who I may be... I may be any one who lives in GT, Works in GT, and that does not exclude City Employees, Contracted Employees, Vendors, or "Assumed Friends".

My neighbors are asking me what to do next about this proposed subdivisionnext to us. Hell if I know, that was the wierdest Planning Commission I've ever seen in action.

City Attorney seemed completely lost, befuddled and useless. Ditto the CD Director. Six of seven commissioners showed for the first meeting but only three of seven for the follow up meeting. We raised all sorts of issues about the zone change, drainage, utilities, aproposed alley up to our property line, pad heights, looming 2 story homes, the wisdom of building homes up next to a 3 million gallon reservoir, increasing traffic on Pico through a zone change (Pico has alot of kids), our flimsy wood fences being inadequate etc. but got almost no response on any of these issues.

PS: I wonder why the day they hold the Grand Terrace Day Parade and Festit always seems to be about 195 degrees? Every timewe go to this shin dig I want to leave as soon as we get there. Sizzlinghot food, sizzling hot day and not much shade. Priceless. Or should it be Over Priced would be a better way of saying it. Those Donations could be better spent in a number of ways.

Grand Terrace

His run is over
*
On May 20, Grand Terrace City Councilwoman Bea Cortes held an open "Meet the Candidates" reception for Bill Postmus. City voters received invitations.
*
Not surprisingly, no one showed up other than the couple who helped set up the reception. Asking Cortes to host a Meet the Candidates reception is like asking a dog catcher to perform surgery on you. Postmus' popularity has taken a downward spiral, and in his desperate attempt to win over voters, he made a fatal move: He depended on Cortes' name recognition to gain favor in Grand Terrace, Colton and surrounding cities.
*
Postmus and his campaign managers have failed to do their homework on the 65-year-old Cortes. She has the name recognition all right. As a matter of fact, she is right up there in the Grand Terrace Hall of Shame, along with the first director of First 5, Don Larkin, and Matt Brown, Supervisor Paul Biane's chief of staff. We all remember the fiasco created when Biane tried to install Brown's wife as director of First 5.
*
Cortes' own Hall of Shame goes back decades. She was fired from the well-respected state Sen. Nell Soto's office, and also fired from Assemblywoman Gloria Negrete McLeod's. No self-respecting Republican wants their name to be associated with hers.
*
The only reason she is still around is because Republican Brown went to the curb and took her under his wing birds of a feather fly together. In fact, Brown invited her to be a member of the Republican Central Committee. Democrats have not stopped laughing yet.
*
Postmus has shown very poor judgment and lack of research in associating his name with the likes of Cortes. We've seen the rise of a promising young man in Postmus and now we are all witnessing his fall. He has been caught in the very thing he set out to abolish corruption. His boat is leaking, and he is going down by way of his own arrogance, sense of entitlement and lack of respect for other professionals.
*
His campaigning never gained momentum, nor did he even provide voters with a vision or direction for the office he is seeking. His work for the voter-taxpayer is over. We have nothing to gain in keeping him around.

Recall In Press Media

Grand Terrace residents vow to press recall
SETBACK: The latest petition fails to meet election code rules, the city clerk says.

10:00 PM PDT on Friday, June 2, 2006
By PAUL LAROCCO
The Press-Enterprise

GRAND TERRACE - Residents hoping to force the city's first recall election promised Friday they won't be dispirited by the latest rejection of their petition to get the process started.

City Clerk Brenda Mesa invalidated a petition to recall Mayor Maryetta Ferre and Councilwoman LeeAnn Garcia on Thursday because it did not include printed names as well as the signatures of those who signed it, as required by state election code.

Last month, a first attempt to serve the city with a notice of intent petition also failed because of a lack of proper signatures, City Manager Tom Schwab said.

Bill Hays, a council critic who served the most recent petition, said getting another 20 resident signatures with printed names and addresses will not be a problem.

He acknowledged the first petition, which he did not submit, was hastily gathered, but said dissatisfied residents have been mobilizing, and are not willing to let minor setbacks derail recall efforts.

"We are confident we'll achieve even more (signatures) this time," Hays said. "This is a community action."

When he presented the second recall petition at the May 25 council meeting, Hays said Ferre and Garcia had forgotten they serve a representative form of government, and had let city staff and developers lead them.

He cited as the final straw a recent vote in favor of moving an electrical warehouse to a site he said does not comply with the city's general plan.

"There's an arrogance by some of the council members when it comes to the public," Hays said Friday, repeating a phrase he used at that meeting. "It's like we're the unwashed, huddled masses."

Hays said residents would also like to see Councilwoman Bea Cortes recalled, but since she is up for re-election this fall, she could not be included. Ferre and Garcia's terms expire in 2008.

Ferre dismissed the accusations as baseless the night of the meeting, and has promised she will refute every point made by the petition.

She and Garcia -- who has yet to publicly comment on the recall petition -- did not return calls Friday.

Cortes, however, defended herself and her targeted colleagues, calling the recall "ridiculous."

She said she always listens to the public, just not in the way that yields immediate dialogue and responses at council meetings.

"But this is the same group that has always had issues with any kind of item that comes before us," she said.

"Any project, they're opposing it."

If the notice of intent petition is validated, recall proponents have 90 days to obtain about 1,500 resident signatures, or 25 percent of the city's 5,964 registered voters.

If that is done, the City Council must set a recall election date, according to Schwab.

The city manager refused to comment Friday on the prospect of a recall, something Grand Terrace has never experienced in its near-30-year history.

Proponents, however, could continue to submit petitions as many times as they need, he said.

"They can do it once a day for a year," Schwab said.

Gramps Says:
*
Let's be clear on a few things.
*
The "Group" isn't an single issue association of people who have all united against All City Plans or actions in the Past. This type of all inclusive and absolute statement made by both Mayor Ferre when she first was served the initial Recall Notice and now again stated by CouncilMember Bea Cortes is in error.
*
Private Development, done without RDA funds, threats and debt are seldom commented upon by the petitioner requesting a Recall. Exception being the ill fated Manhole Builders Project proposed and rejected by even the closest supporters of the Council in addition to those the Mayor Ferre and Council Member Cortes target by their statements.
*
Councilmember Cortes's statement also validates the current council does not believe in or listen to anything a citizen says or Yes, Bea Cortes does not have dialogue with anyone other than those that are in a political office that come before the council or to patronize those that will help her political career, or her Realty Sales.
*
Mayor Ferre's made up law does not allow dialogue with a citizen by a council member. It is not Law, it is A Mayor Ferre Dictate, Councilmember Cortes clearly supports and practices.
*
The City Clerk has the responsibility to aid the citizens in filing the forms. One must ask if there has been much cooperation from the clerk in regards to communicating or providing a blank form to the citizens attempting to exercise their rights?
*
Now that the big hidden truth is Out, one must question Mr. Schwabs reasoning for non disclosure of the reasons for rejection, and if the Clerk has provided sufficient advise and direction so that the Documents can be finalized and not turned into perpetual ping pong game over things like line numbering, margins, or font size. The Clerk provided a 30 something page guide, but this guide does not include a model or template. It describes the form, and the process, but it is inclusive of State to Local Recalls and distilling it to the local level should be the expertise of the City Clerk who is obligated to aid the citizen in preparing the required documents.

Recall Update:

The Recall has been Sent Back to the petitioner for Corrections.
The City Clerk Rejected the Petition of Intent to Recall
the Mayor Ferre and Councilmeber Garcia.

The City Manager apparently is not willing to Release to the Public the Specific Reason for the Rejection until Service to the 20 signers of the document have received Registered receipt of the Decision. It is an odd thing that once the letter is written, and sent, isn't it PUBLIC RECORD. Shouldn't it be available to the PRESS and the PUBLIC?

Isn't this yet another demonstration of the secretive, obfuscating, and inappropriate conduct of City Manager Tom Schwab and his management style which percolates throughout the City Offices? If there is a review, and a letter sent, make it and its content public.

The Recall petitioner have 10 days to make corrections, and Reserve the Mayor Ferre and Council Member Garcia. There are several steps in the process it is interesting the City feels a need to hold back on information.
The Recall does not site unnecessary development. It does site Debt, and ill planned RDA plans, and other actions which have resulted in legal action against the city, including but not limited to Brown Act Violations requiring particular actions after a Closed Meeting of the Council or RDA.

By JULIE FARREN
The Press-Enterprise

A petition asking to recall the Grand Terrace mayor and a council member was ruled invalid Thursday by the city clerk because it doesn't meet state election requirements, the city manager said.

Certified letters were mailed to those who proposed the recall, according to Tracey Martinez, deputy city clerk.

Officials would not say why the petition did not meet the criteria needed to move ahead with a recall of Mayor Maryetta Ferre and Councilwoman Lee Ann Garcia.

City Manager Tom Schwab said petition backers did not include "certain statutory information." The city also didn't want to comment until petition proponents receive the city's letter, Martinez said.

Ferre was not available Thursday evening.

Petitions notifying Ferre and Garcia of an intention to stage the recall were served by city resident Bill Hays at a May 25 council meeting.

Ferre and Garcia, who are up for re-election in November 2008, were accused in the petitions of issues ranging from holding secret meetings to exposing the city to litigation by approving unnecessary developments.

Hays said Thursday evening he would comment after he receives the letter. He said the petition had the required 20 signatures.

"Everybody was a registered voter, and that is all that is required," Hays said.

The signatures were reviewed by City Clerk Brenda Mesa. If the petition had been declared valid, Ferre and Garcia would have been given 30 days to respond.

The citizens would then have been required to prepare another petition with 1,500 signatures for the recall to move forward, Hays said.

Martinez said the petition can be resubmitted.

The Following Arrests took place after it took 30 minutes to respond to a Home Invasion Call at 6:00 or 18:00 hours, on Barton Road. Responding Officer did not process or collect available evidence. Where was the Officer between 12:00 and 18:00 Hours June 1, 2006. That is the question. This is why the Citizens should be able to see a Call or Dispatch Log... Perhaps a redacted one with the Callers name and specific address removed, but the time, and general area and type of call and responce time should be listed, and made available on line.

Group files lawsuit against GT to block business construction

Stephen Wall, Staff Writer
San Bernardino County Sun

GRAND TERRACE - For the third time in less than two years, the city is being sued by a group of residents opposed to a development project.
A group calling itself Citizens for an Open and Responsible Government filed a lawsuit last week seeking to block construction of an electrical-wholesale business on Commerce Way.

The same group sued the city in November to stop a 120-unit senior-housing complex on Grand Terrace Road.

In October 2004, a group known as Citizens for a Better Grand Terrace took the city to court to challenge a proposed outdoor-themed retail center.

The latest lawsuit was filed May 22 in San Bernardino Superior Court by Raymond Johnson, the Temecula-based attorney who represented the residents in the other two cases.

Johnson did not return phone calls seeking comment.

City Attorney John Harper said he has not seen the lawsuit and could not comment. He predicted it would be about six months before the case goes to trial.

The most recent suit claims the project by Essco Electric is inappropriate for the area and would generate unacceptable environmental impacts.

The Planning Commission in April gave Essco permission to move its operations to a 2.4-acre site across the street from its current location.

On May 11, the City Council denied an appeal of the commission's decision, allowing the development to move forward.

The lawsuit claims the project would produce excessive amounts of traffic, noise and air pollution. It also criticizes the city for failing to study how the project would affect the burrowing owl, a rare bird considered a species of special concern in California because of its dwindling numbers.

City officials said adequate environmental reviews were performed and the operation is suitable for the area.

"The lawsuit is completely without merit," City Manager Tom Schwab said. "It's an existing business that's just moving across the street. All of the issues from an environmental standpoint were addressed."

The project site is in an area designated for the so-called Outdoor Adventure Center, a 123-acre housing and retail plan just east of Interstate 215.

Some nearby residents say the Essco project conflicts with the city's General Plan and specific plan for the adventure center.

"To tell me that this represents the Outdoor Adventure Center flies into the face of any intelligent person," Michigan Avenue resident Patricia Farley told the Planning Commission.

Bill Hays, who lives on De Berry Street about a block from the Essco site, said the project does not comply with city guidelines.

"It does not fit with the General Plan or the specific plan for the area," said Hays, 59. "It goes against both of them."

City officials said the Essco project is permitted within the Outdoor Adventure Center plan and meets zoning requirements.
Essco, which has done business in Grand Terrace for about 12 years, resells pre-manufactured electrical products including wire, cable, breakers, bulbs and lighting fixtures. The company, which employs 35 people, is the city's largest sales-tax generator.

Inland man's robbery charges dropped
MISTAKEN: Michael Lee Brown, of Moreno Valley, was accused of 40 bank thefts. Another suspect confessed.
10:00 PM PDT on Wednesday, May 31, 2006
By KENNY KLEINThe Press-Enterprise
Even after his arrest in connection with a series of bank robberies in Riverside, San Bernardino and Orange counties, Michael Lee Brown knew authorities had the wrong man.
"I told them from day one they got the wrong person," said Brown, 35, of Moreno Valley. "I feel raped. If you get accused of something like this and you did not do it, the only people that believe you are the people that know you. It's just crazy. You name it and I've lost it over this."
On Wednesday, Judge Gary B. Tranbarger dismissed about 40 bank robbery related-charges against Brown in Riverside County Superior Court. A hearing on the last remaining count, which involves having a sawed-off shotgun in his home, is scheduled for July 7.
Brown was arrested by Riverside County Sheriff's deputies and other officers Feb. 17, 2005, at his Lemon Gum Court home on suspicion of committing bank robberies in Hemet, Moreno Valley, Irvine and San Bernardino, police said. Brown was later charged and spent several months in county jail, records show. Brown posted a percentage of his $250,000 bail and was released Aug. 18, 2005, according to court records. A key break for Brown took place in April, when a man matching Brown's physical description was arrested robbing a Baldwin Park bank. That man later admitted to a Hemet detective he worked alone and robbed all the same banks Brown had been blamed for.
Riverside County Deputy District Attorney David Steward, who was prosecuting the case, said the investigation revealed Brown had nothing to do with the bank robberies. He said there was evidence linking Brown to the crimes, including an eyewitness who identified Brown as the robber, but it turned out to be a case of mistaken identity.
"The checks and balances worked," Steward said Wednesday by telephone. "Justice was ultimately served."
Brown's Upland-based attorney Duane Dade said authorities never found any physical or scientific evidence, including the stolen money, dye packs, clothing or the specific type of bag used. Authorities did find a black and silver gun, not the black gun seen by witnesses at the robberies.
"They went through mug shots and were looking for a big black guy and found a big black guy," Dade said. "Based on that, you get a warrant somehow.
"There is nothing to put him at the scene and no physical evidence," Dade said. "While Mr. Brown was in custody, another bank robbery happened in San Bernardino (County). It was the same MO (method of operation) and same description."
Then in April, a 36-year-old Lake Elsinore man, who also matches Brown's description, was arrested in Baldwin Park on suspicion of several bank robberies.
Hemet Police Detective Michael Elmore, who investigated the Hemet cases, said he interviewed the Lake Elsinore man. Elmore said the man told him he worked alone and conducted all the bank robberies -- Hemet, Moreno Valley, San Bernardino, Grand Terrace and Irvine -- for which Brown had been arrested and charged. The man remains in jail and is expected to appear in court June 14, Baldwin Park Police Lt. Raul Martinez said Wednesday.
Elmore said the descriptions of Brown and the other man are almost identical. Both weigh about 300 pounds and look like football players, police said.
Hemet Police Capt. Rob Webb said Brown did not commit any bank robberies in Hemet.
"Our detectives completed a very detailed investigation and believe that Mr. Brown did not commit any robberies in Hemet," Webb said.
Brown, who pleaded guilty to a theft case and had it reduced to a misdemeanor in the late '90s, said he's lost jobs, including auto repossession route that helped him support his wife and three children, ages 8, 9 and 10.
"I'm just hanging on," Brown said. "I could not have gotten through this without the help of my family."
Brown said he plans to sit down with his children now that the charges are behind him.
That will be no easy task because his family remembers officers showing up at his door with their guns out and handcuffing him, Brown said.
"I tell my kids if they go to school, this type of stuff won't happen," Brown said. "We have not sat down with them yet and explained it. Every time I see a cop, I think to myself anything can happen. I just don't trust them like I used to."
