This is the Case Filed regarding the “Current Plan” for the Blue Mt. Senior Villas. Parking and Traffic and other EIR Issues are still part of this legal action. Note the EIR Presented concluded the BEST SITE for the Senior Center and housing is on Barton Rd where it was specified in the General Plan. This would put the Seniors close to existing Public Transportation and services.

One has to wonder why they are still holding tight onto this “Plan” by either not satisfying Judge Wades Concerns and returning to his court, or just moving on. This case has been brought against Swertfegers and the City as a result of the City not enforcing Code Specifications and Conditional Use Permit Conditions upon Swertfeger, and Swertfeger’s perpetual violation of said code and condition, inflicting the neighborhood with conditions conflicting with their right to enjoy their property and safety.
