More Than 700 New Laws Now In Effect Statewide

Several hundred new laws passed by the state legislature went into effect on January 1. In 2010, then-governor Arnold Schwarzenegger signed 747 bills into law last year.

Some of the laws are a revamping, recision, or partial recision of old ones. The threshold for a grand theft charge rose from $400 to $950. Marijuana possession in small amounts is now an infraction, not a misdemeanor. The Department of Mental Health will no longer be under the requirement of a 60-year-old law to research the causes and cures for homosexuality.

The Expedited Jury Trials Act (AB 2284), authored Assemblywoman Noreen Evans, D-Santa Rosa, took effect this month. Modeled on similar fast trial tracking laws in New York and South Carolina, is intended to change the adjudication of civil disputes in California and reduce the cost of a jury trial by up to 80 percent. These expedited jury trials are to be heard, on a set date before a judge and jury of eight. The law limits each side to three peremptory challenges, who will be required to present its case and arguments in just three hours, with the goal of concluding the civil trial in a single day.

Other legislation touches on the arena of family law. AB 939 enables litigants to present live testimony in family law matters. Another law, which will not go into effect until next year, AB 1050, provides 14-year-olds in family law cases the right to testify unless there is citation of a reason why their testimony should not be heard.

A summary of some of the new laws follows:

Under SB 1317, parents who do not ensure that their children are attending school can be charged with a misdemeanor and face a maximum penalty of one year in jail and a $2,000 fine.
AB 1280, also known as as Adam’s Law, provides for stiff punishments up to and including life without the possibility of parole for abuse by a parent or other caregiver that causes a child under the age of 8 to go into a coma or become permanently paralyzed.
AB 1844 provides harsher penalties for sex offenders who prey on children and an additional fine of up to $100,000 if a commercial sex act is involved.
AB 1963 mandates that the results of ongoing lab tests related to farm workers’ exposure to certain hazardous pesticides be reported to the Department of Pesticide Regulation as well as certain other state agencies.
SB 1411 makes it a misdemeanor to credibly impersonate someone through or on a website or by other electronic means to harm, intimidate, threaten or defraud others.
Under AB 2479 it is a misdemeanor to tailgate or drive recklessly to photograph, video or tape record someone for commercial purposes. If the subject is a child, the penalty could be a year in jail and a $5,000 fine. Paparazzi are now liable for damages and fines if they falsely imprison someone to capture a photo or recording.
The State Bar president is now required, under AB 2764, to maintain a “Governance in the Public Interest Task Force” to submit a report in 2011 (and every three years thereafter) to the Supreme Court, the governor and the legislative judiciary committees with recommendations for enhancing and ensuring the State Bar’s public protection efforts.
AB 2325 enlarges upon foreclosure consultant restrictions to apply to anyone who performs a forensic audit of a residential mortgage loan.
AB 1373 requires disclosures on posted solicitations offering grant deed copy service to homeowners, including a prominent statutory disclosure that the copy service is not associated with any governmental agency and that the homeowner can obtain such records from the county recorder.
AB 1800 increases the criminal punishment for renting out a residential dwelling without the owner’s consent from six months imprisonment plus a $1,000 fine, to one year imprisonment plus a $2,500 fine.
Under Senate Bill 931, as of January 1, 2011, a seller’s first trust deed lender cannot obtain a deficiency judgment against the seller after a short sale. Providing written consent to a short sale obligates the first trust deed lender to accept the sales proceeds as full payment and discharge of the remaining amount owed on the loan. This law applies to first trust deeds secured by one-to-four residential units, but does not limit the lender from seeking damages for fraud or waste by the borrower.
AB 1809 dictates that a home inspection and inspection report may, upon a client’s request, include an audit of the energy efficiency of a home, according to the standards of the Home Energy Rating Systems (HERS).
Under AB 1684, effective January 1, 2011, a claim for adverse possession requires, among other things, certified records of the county tax collector showing that all state, county, or municipal taxes have been timely paid for the five-year period the property has been occupied and claimed. Existing law merely requires proof that taxes have been paid for the five-year period, not certified proof of timely payments.
SB 1137 makes anyone acting as a mortgage loan originator (MLO) without an MLO license endorsement guilty of a crime punishable by six months imprisonment, plus a $20,000 fine. Nor can a broker employ or compensate a real estate licensee for MLO activities unless that licensee has a license endorsement. This law also gives the Department of Real Estate the authority to deny or revoke a MLO license endorsement or take other action. This law also amends the MLO requirements for finance lenders and residential mortgage lenders under the Department of Corporation.
SB 1149 requires that a notice to terminate a residential tenant who remains after a foreclosure sale must include a statutory notice of the tenant’s rights. This requirement, which sunsets on January 1, 2013, applies to an immediate successor-in-interest for one year after a foreclosure sale. The tenant’s rights must be on a separate cover sheet or, for a 90-day termination, incorporated into the notice to terminate. Another provision of this bill protects a residential tenant’s credit by generally prohibiting the court clerk from revealing unlawful detainer court records unless the plaintiff prevails at trial.
SB 782 prohibits a residential landlord from terminating or failing to renew a tenancy based on domestic violence against the tenant or tenant’s household members. This law applies if the person restrained from contact with the tenant by court order or named in a police report is not also a tenant of the same dwelling unit. If the protected tenant subsequently allows the person restrained to visit the property, or the landlord reasonably believes the person restrained poses a physical threat to others or to quiet possession by other tenants, the landlord may serve a three-day notice to correct or quit. To further ensure safe housing for domestic violence victims, this law also requires that, for leases entered into after January 1, 2011, a landlord change the exterior locks of a protected tenant’s dwelling unit within 24 hours after the tenant provides a written request and supporting court or police documentation as specified.
SB 183 requires existing single-family homes with fossil fuel-burning appliances or heaters or an attached garage or a fireplace to be outfitted with carbon monoxide alarms by July of this year. Other dwellings, such as hotels, must make the change by 2013.
AB 1952 requires a person under 21 years of age to complete an approved motorcycle safety course before being issued an instruction permit with which to practice operating a motorcycle, and requires the permit to be held for six months before being issued a class M motorcycle driver license. There are currently more than 6,000 drivers 19 years and younger who are licensed to ride a motorcycle in California.
AB 2499 undoes prior law that only licensed and regulated "brick and mortar" classrooms can house traffic violator schools. This new law will bring court-approved courses, such as online and home study traffic schools into the DMV Traffic Violator School licensing program and implements a number of recommendations included in a DMV study of traffic violator school issues. This law will have a 3-year implementation process.
SB 535 extends a prior law permitting fuel-efficient, low-emission vehicles to display stickers allowing them to be operated in HOV lanes with a single occupant that was to expire on January 1, 2011. The new law extends the "sunset" date for the yellow stickers for hybrid vehicles until July 1, 2011; the white stickers issued to fully-electric and compressed natural gas vehicles until January 1, 2015; and creates a third sticker, for plug-in hybrid vehicles, to be issued and valid from January 1, 2012 until January 1, 2015.
AB 1648 simplifies the proper licensing of firefighters, exempting operators of firefighting vehicles from the Commercial Driver License program and creates a new license endorsement process.
SB 1399 requires permanently medically incapacitated prisoners be granted medical parole if they meet certain criteria and the Board of Parole Hearings concludes they do not pose a threat to public safety. Prisoners facing sentences of death or life without the possibility of parole are not eligible for release under this law.
AB 2487 mandates that a judge disqualify himself or herself from any matter in which one of the attorneys or parties contributed more than $1,500 to that judge’s future election campaign or last election that took place within the previous six years.
AB 1675 makes it an infraction or a misdemeanor to enter an animal enclosure at a zoo, circus, aquarium or traveling animal exhibit without permission.
SB 1449 reduces marijuana possession to an infraction with a maximum $100 fine when the amount possessed does not exceed 28.5 grams.
AB 2650 prohibits medical marijuana clinics and dispensaries from being located within 600 feet of any public or private K-12 school. Existing local ordinances that regulate the location or establishment of such dispensaries and any other zoning restrictions remain in effect.
Some legislation passed in 2010 went into effect prior to January 1, including the prohibition of the sale of electronic cigarettes to minors.
Other laws were not in effect as of January 1, but will become binding later.
In February AB 962, which was passed in 2009, will require handgun ammunition sales and deliveries be done in person and that buyers provide identification and a thumbprint.
In July, SB 1395 goes into effect, requiring the Department of Motor Vehicles to provide information on registering as an organ donor and verbally asking all applicants for licenses if they are willing to enroll in the organ registry. The bill also sets up the nation’s first living donor registry for kidney transplants.
Also in July, AB 211 will kick in, requiring all new construction plans for schools to incorporate doors that lock from the inside.
In 2012, AB 2079 will effectuate, forcing colleges to publicly disclose their policies concerning sports-related medical expenses, scholarship renewal standards and out-of-pocket expenses that athletes on full athletic scholarships will be expected to pay.
AB 1602 and SB 900 create the California Health Benefit Exchange to help consumers and businesses, beginning in 2014, shop for competitive health insurance.
SB 657, which becomes law in 2012, will require California’s major retail sellers and manufacturers to disclose their voluntary efforts to eradicate slavery and human trafficking from their direct supply chain for merchandise they sell.
