Recall Update:

The Recall has been Sent Back to the petitioner for Corrections.
The City Clerk Rejected the Petition of Intent to Recall
the Mayor Ferre and Councilmeber Garcia.

The City Manager apparently is not willing to Release to the Public the Specific Reason for the Rejection until Service to the 20 signers of the document have received Registered receipt of the Decision. It is an odd thing that once the letter is written, and sent, isn't it PUBLIC RECORD. Shouldn't it be available to the PRESS and the PUBLIC?

Isn't this yet another demonstration of the secretive, obfuscating, and inappropriate conduct of City Manager Tom Schwab and his management style which percolates throughout the City Offices? If there is a review, and a letter sent, make it and its content public.

The Recall petitioner have 10 days to make corrections, and Reserve the Mayor Ferre and Council Member Garcia. There are several steps in the process it is interesting the City feels a need to hold back on information.
The Recall does not site unnecessary development. It does site Debt, and ill planned RDA plans, and other actions which have resulted in legal action against the city, including but not limited to Brown Act Violations requiring particular actions after a Closed Meeting of the Council or RDA.

A petition asking to recall the Grand Terrace mayor and a council member was ruled invalid Thursday by the city clerk because it doesn't meet state election requirements, the city manager said.

Certified letters were mailed to those who proposed the recall, according to Tracey Martinez, deputy city clerk.

Officials would not say why the petition did not meet the criteria needed to move ahead with a recall of Mayor Maryetta Ferre and Councilwoman Lee Ann Garcia.

City Manager Tom Schwab said petition backers did not include "certain statutory information." The city also didn't want to comment until petition proponents receive the city's letter, Martinez said.

Ferre was not available Thursday evening.

Petitions notifying Ferre and Garcia of an intention to stage the recall were served by city resident Bill Hays at a May 25 council meeting.

Ferre and Garcia, who are up for re-election in November 2008, were accused in the petitions of issues ranging from holding secret meetings to exposing the city to litigation by approving unnecessary developments.

Hays said Thursday evening he would comment after he receives the letter. He said the petition had the required 20 signatures.

"Everybody was a registered voter, and that is all that is required," Hays said.

The signatures were reviewed by City Clerk Brenda Mesa. If the petition had been declared valid, Ferre and Garcia would have been given 30 days to respond.

The citizens would then have been required to prepare another petition with 1,500 signatures for the recall to move forward, Hays said.

Martinez said the petition can be resubmitted.
