A. Proclamation - Fun in the Sun, Safe Summer 2006

Councilwoman Garcia read a proclamation proclaiming May 29, through September 4, 2006 as AFun in the Sun, Safe Summer 2006" in the City of Grand Terrace urging all citizens to support this campaign by circulating materials, and by Aactively supervising@ children, thereby helping them stay safe in cars, in water, and on the roads and sidewalks and presented it to Chief Bush from the San Bernardino County Fire Department.

B. Arson & Bomb Detail/Presentation on Fireworks - Dan Glozer

Dan Glozer, San Bernardino County Sheriff’s Department introduced himself and gave a brief history of his background. He gave an overview on fireworks, talked about injuries and damage caused by fireworks, and went over the laws dealing with fireworks.
Councilmember Garcia reported what the times are for the sale and discharge of fireworks . She reported that on July 4th there will be a staff member available from 7 p.m. to 12 midnight to take calls reporting the use of illegal fireworks. She thanked the Fire Department and the Sheriff’s Department for everything that they have done.

C. Proclamation - Terrace Hills Middle School

Councilmember Miller reported that the Colton Middle School and Terrace Hills Middle School played in the Ken Hubbs Flag Football Classic as opponents on April 19, 2006. He read a proclamation that was presented by the Colton City Council and will present it to Terrace Hills Middle School. He stated that they will do it again next year in Grand Terrace.

3D. Resolution Calling a General Municipal Election - November 7, 2006

CC-2006-69 MOTION BY COUNCILMEMBER MILLER, SECOND BY , CARRIED 5-0, to approve a Resolution calling a General Municipal Election on November 7, 2006 and direct the City Attorney to prepare a written opinion on whether or not someone can run for City Council and Mayor during the same election and if there is a recall question on the ballot for two Council Seats does an individual run for a specific seat or do the top two candidates fill those terms.

PUBLIC COMMENT
Brian Phelps, 22857 Wren Street, reported on the fireworks changes for this year. He stated that there will be a higher level of enforcement out in the community. He urges residents to purchase only safe and sane fireworks that will be sold by the youth organizations in town. He reported on the dates and hours of sale and discharge of fireworks in Grand Terrace. He urged residents to use common sense and to be respectful of your neighbors.

Cynthia Bidney, 12219 Pascal, stated that Councilmember Garcia stated in her response to the Notice of Intent to Recall her from her position that there was 5 million dollars in reserve. She questioned where that money actually is, is it income, savings or is it RDA money and is it tagged to be spent for anything. In light of that statement, she would like to know why Mr. Hilkey asked Mr. Schwab at a prior meeting why the City is spending 2 million dollars more than we are taking in.

Bill Hays, 22114 DeBerry Street, served Mayor Ferré again with a Notice of Intent to Recall. He stated that he has attempted to serve other Notices of Intent and that they were insufficient per code. He stated that each Notice of Intent referred to Maryetta Ferré as Mayor and that she is in fact not elected as the Mayor, she was elected to serve as a Councilmember. He stated that should any of the Councilmembers that are sought to be recalled run for Mayor and are successful, the group will begin the recall process for that position.

Bobbie Forbes, 11850 Burns Avenue, stated that with the upcoming holiday there will be a lot of pets that will get lost. She reported that The Sun, The Press Enterprise as well as the Blue Mountain Outlook will run lost and found ads for lost pets. She stated the Animal Emergency Hospital will scan found pets as well as the Animal Control Officers in town. She stated that she is opposed to fireworks. She indicated that the Chamber of Commerce will start their new year on July 1, 2006 with their new Board of Directors. She thanked those who attended the installation banquet and everyone that participated and supported the Chamber of Commerce

over the past two years while she was President. She also thanked the Executive Board and the Board of Directors for doing their job. She stated that the Blue Mountain Outlook will continue to bring the residents of Grand Terrace local information and events and advertise for the local business. She encouraged everyone to support the local businesses.
Brian Phelps, 22857 Wren Street, invited everyone to attend the All Star Tournaments at Pico Park.

City Manager Schwab, responded that the 5 million dollar reserve is actually the General Fund reserve. He stated that there is 14 million dollars in the overall cash position. Those particular funds are held in cash, CD’s, US Government Securities and the Local Agency Investment Fund, which is an investment vehicle that is managed by the State. The 5 million dollars is the amount that staff is projecting, the current General Fund Reserve is 4.8 million and the budget that was just adopted projects that it will increase to 5 million dollars by the end of the Fiscal Year. As far as the comment that the overall expenditures were higher than the overall revenues, that is when you take into consideration the entire budget. When you look at the entire budget this year it was indicated that the City is spending more money than is bringing in and that it is primarily due to the fact that the 120 unit Senior Housing Project and Senior Center is going to use up approximately 9 million dollars of equity in the Housing Fund in the Redevelopment Agency. That is causing us to dip into the savings account in the Housing Fund in order to fund that project.

Councilmember Hilkey, stated that the reason that he clarified that was because the prior year there was a erroneous news report that we had a 27 million dollar budget and because it took along time to clarify that he wanted to be sure to get it on the table right away that our budget was 18.3 million dollars and part of that was 2 million dollars that we were pulling out of the 20% set-aside finishing the major project for the seniors.

5B. Council Reports
Councilmember Hilkey, stated that when Mr. Phelps was speaking he stated that Fireworks were not allowed on private property and that he believed that we received a request from an organization to do fireworks at the Park on the 4th of July.
Assistant City Manager Berry, responded that the Brook requested to do fireworks at Rollins Park, however, staff let them know that our Codes do not permit fireworks in public parks and therefore no fireworks will be done at the park.

Councilmember Hilkey, stated that there was an ongoing request for a report on Swertfeger Trucking. He stated that there is a long report on this company and clarified that the existing Conditional Use Permit does not have any hours of operation. Council waived the Traffic Mitigation Fee because they were just implementing the fee and there wasn’t a fee in place at that time. When the report gets to the Council he wants to make sure that those who have complained get a copy of the report right away. He questioned if the City has a list of pool owners in town.

Assistant City Manager Berry, responded that he doesn’t believe that it does.
Councilmember Hilkey, questioned if there was anyway to find out who is a pool owner so that educational information on pool safety can be mailed out.

Assistant City Manager Berry, responded that the only way he thinks staff to do that is to look from the sky.


Councilmember Garcia, reported that one way to inform the public is through the media outlets. She reported that the Pancake Breakfast was well attended and encouraged residents to stop by and talk to the Firefighters at the local station if they have any questions regarding safety issues. She stated that there are a lot of things going on this summer. She reported that the Library Summer Reading Program for ages birth to 12 years is beginning and that if the child reads 5 books they get one incentive after 5 they get a prize. She reported that on June 15 at 6 pm they will have the program Wonders of Wildlife. There will be a program on June 22, June 29, July 6

and July 20. They are also having a Pet Photo Contest and will be taking in Photos until July 26th. She reported that she attended the Flag Retirement Ceremony that was put on by the Boy Scouts Association. She felt that it was very educational and thanked Chuck Collier and the Boy Scouts for the program. She reported that the Chamber of Commerce has been busy. She recognized Sid Bailey for being named the President and Bruce Bebow and the Vice-President. Dana Darwin is the Secretary and Jaci Hamill is the Treasurer. She thanked the Chamber for all of the work that they do for the local businesses. She reported that there is a new owner for Rags for Dolls and that they had a ribbon cutting ceremony on June 17th. She reported that Dan Glozer from the Sheriff’s Department gave the presentation at the Chamber Luncheon on fireworks. There was also a representative from Senator Dutton’s office there. She stated that the goal of the General Plan Task Force was to protect Blue Mountain. There is a group, Friends of Blue Mountain Wilderness Trail and Park Program, that is led by Dennis Kidd that is working on preserving Blue Mountain. They will be selling t-shirts at the Concert in the Park in August. She requested that Assistant City Manager report on the group.

Assistant City Manager Berry, stated that they are currently gathering information but their goal is to create a wilderness park that connects with the Box Springs Park through trails. They are looking at getting funding through land conservancies.
Councilmember Garcia, indicated that she was excited when she heard about this project. She requested Lt. Guerra to talk about the theft of copper lines and the issue of the cutting of the telephone lines.

Lt. Guerra, San Bernardino County Sheriff’s Department, reported that there was a theft of telephone lines off of the poles along La Cadena. The theft had to take several hours but the average citizen would probably not recognize it and report it. They stole several thousands of feet of phone cable, which disrupted service to part of the City. They have minimal leads on the case. If anyone has any information they should contact the Sheriff’s Department.

Councilmember Garcia, encouraged people to call the Sheriff’s Department or City Hall if they see something suspicious. She requested that Assistant City Manager Berry report on a Street Closure.

Assistant City Manager, reported that there was a street closure on La Cadena and Barton on Tuesday and Wednesday. The street is now open and La Cadena was never closed. It was part of the La Cadena

Improvement Program that Council approved $115,000.00 for. The project should be completed as of tomorrow. Colton will be moving forward with the traffic signal at the intersection.


Councilmember Garcia, reported that she drives a lot throughout the community and thanked City Staff for removing graffiti. She encouraged residents to report graffiti by calling the hotline at 909 430-2265. She reported that there will be a Concert in the Park on August 18 from 7:00 to 8:30 p.m. All Grand Terrace non-profit groups will be allowed to have a booth.

Assistant City Manager Berry, stated that the Riverside Concert Band will be performing once again this year.

Councilmember Garcia, reported that there are over 100 children that will be participating in the Blue Waves Swim Program. She stated that there is a contact us on the Website and that anyone that has questions regarding the City should send an e-mail. She wished everyone a safe 4th of July and encouraged residents to call the City if they see the use of illegal fireworks or have concerns.

Councilmember Miller, stated that the City of Grand Terrace sign as you are coming up from San Bernardino has been tagged and also the sign coming up the back way has been hit. He questioned if there is going to be any type of weed abatement at the base of Blue Mountain.

Assistant City Manager Berry, responded that he contacted the property owner and he indicated that he received his weed abatement notice from the County and paid the fee for them to do the removal and that haven’t done it to date. He stated that he will contact San Bernardino County and check on that.

Mayor Pro Tem Cortes, reported that she attended the Grand Terrace Area Chamber of Commerce Installation Dinner and that it was very nice and well attended. She also attended the luncheon and felt that it was informative. She attended the Friends of Blue Mountain with Assistant City Manger Berry and found it to be interesting. There were a couple of residents that were under the impression that there was going to be a park on Blue Mountain. She reported that if you would like to purchase a t-shirt you can join the group for $32.00 and get a t-shirt for $12.00 or don’t join and purchase one for $15.00. She stated that Council received an e-mail regarding graffiti and requested that Assistant City Manager Berry comment on graffiti.

Assistant City Manager Berry, responded that the City got hit pretty hard just a few days ago. It appeared to be one person. Staff has been working on cleaning it up and will continue to do so until it is gone. He stated that huge stickers are now going up.
Mayor Ferré, questioned staff if there is some type of time line on the traffic signal at LaCadena and Barton Road.

Assistant City Manager Berry, responded that he will get with the City of Colton, however it is his understanding it should be happening soon.

Mayor Ferré, sincerely thank Bobbie Forbes for the two years that she was the President of the Chamber of Commerce. The Chamber has done some wonderful things and worked very hard and she is very appreciative of their work. She reported she attends the Chamber Luncheons on a regular basis and feels that they are excellent. She thanked the Fireworks Committee, and expressed her appreciation for all of the work that they have done and the way they handled the entire process. She is anxious to hear the outcome of their efforts.

PUBLIC HEARING
6A. 2006-2007 Annual Assessment Landscaping and Lighting District No. 89-1
City Manager Schwab, stated that the Council set this date for the Public Hearing to adopt the Resolution for the Annual Assessment Levy. Staff is asking for the Public Hearing to be conducted and for the Council to adopt the Annual Assessment Levy Resolution.
Mayor Ferré opened the Public Hearing for discussion, there being none, she returned discussion to the Council.
