(a) Every person who willfully obtains personal identifying information, as defined in subdivision (b), of another person, and uses that information for any unlawful purpose, including to obtain,or attempt to obtain, credit, goods, services, or medical informationin the name of the other person without the consent of that person, is guilty of a public offense, and upon conviction therefor, shall be punished either by imprisonment in a county jail not to exceed oneyear, a fine not to exceed one thousand dollars ($1,000), or both that imprisonment and fine, or by imprisonment in the state prison, a fine not to exceed ten thousand dollars ($10,000), or both that imprisonment and fine.

PC647. Every person who commits any of the following acts is guilty of disorderly conduct, a misdemeanor: ............(g) When a person has violated subdivision (f), a peace officer,if he or she is reasonably able to do so, shall place the person, orcause him or her to be placed, in civil protective custody. The person shall be taken to a facility, designated pursuant to Section5170 of the Welfare and Institutions Code, for the 72-hour treatmentand evaluation of inebriates. A peace officer may place a person incivil protective custody with that kind and degree of force which would be lawful were he or she effecting an arrest for a a warrant. No person who has been placed in civil protectivecustody shall thereafter be subject to any criminal prosecution or juvenile court proceeding based on the facts giving rise to this placement.
